Tune-Up provides remote BMW ECU map customisation ("tuning") services. All tuning is performed remotely using Bootmod3 or MG Flasher platforms. No physical vehicle presence is required.

• Iterative log-based revision sessions (typically 5–10 rounds)
• Customer Portal access for tracking revisions and results
• Special-purpose builds for track, time attack, and race applications

2 Customer Responsibilitiesความรับผิดชอบของลูกค้า

The customer is responsible for the following:

• **Accurate information**: Providing complete and truthful details about the vehicle, hardware modifications, fuel type, and tuning history via the submission form.
• **Vehicle condition**: Ensuring the vehicle is in a sound mechanical condition before tuning begins. Tune-Up accepts no liability for damage arising from pre-existing mechanical issues.
• **Log quality**: Capturing and submitting clear, complete logs as directed by Tune-Up. Poor or incomplete logs may delay or limit the tuning outcome.
• **Correct platform**: Ensuring the tuning platform (Bootmod3 or MG Flasher) is correctly installed and licensed for the vehicle prior to starting.
• **Legal compliance**: Compliance with all applicable local laws and regulations regarding vehicle modifications in your country or region.

3 Pricing & Paymentราคาและการชำระเงิน

• All prices are quoted in Thai Baht (THB) or US Dollars (USD) unless otherwise agreed.
• Final pricing is confirmed before any tuning work begins. Pricing discussed during consultation is indicative and non-binding.
• Payment terms (deposit, full payment, milestone) are agreed between Tune-Up and the customer before the project starts.
• Tune-Up reserves the right to adjust pricing for builds that exceed the originally agreed scope.

4 Results & Expectationsผลลัพธ์และความคาดหวัง

ECU tuning results vary between individual vehicles due to differences in hardware condition, fuel quality, ambient temperature, dyno variation, and other factors. Tune-Up does not guarantee specific power figures or performance targets unless explicitly agreed in writing.

• Tune-Up will make reasonable efforts to achieve the customer's stated goals within the safe operating limits of the hardware.

5 Liability & Riskความรับผิดและความเสี่ยง

ECU tuning modifies the vehicle's factory engine management settings. By engaging Tune-Up's services, the customer accepts the following:

• ECU tuning may void the vehicle's manufacturer warranty.
• Tune-Up accepts no liability for damage to the engine, transmission, drivetrain, or any other vehicle component resulting from: (a) inaccurate or incomplete information provided by the customer; (b) hardware components that are worn, defective, or incompatible; (c) use of incorrect fuel type or quality; (d) the customer operating the vehicle outside the agreed calibration parameters.
• Any damage arising from the use of a Tune-Up map on a vehicle that is not in good mechanical condition is the sole responsibility of the customer.
• Tune-Up's total liability in any circumstance shall not exceed the amount paid by the customer for the tuning service.
• Tune-Up is not responsible for any indirect, incidental, or consequential damages arising from the use of its tuning services.

• ความเสียหายที่เกิดจากการใช้ map กับรถที่ไม่อยู่ในสภาพพร้อม ถือเป็นความรับผิดชอบของลูกค้าทั้งสิ้น
• ความรับผิดของ Tune-Up ไม่ว่ากรณีใดจะไม่เกินจำนวนเงินที่ลูกค้าได้ชำระสำหรับบริการ
• Tune-Up ไม่รับผิดชอบต่อความเสียหายทางอ้อม ความเสียหายโดยบังเอิญ หรือความเสียหายต่อเนื่องใดๆ ที่เกิดจากการใช้บริการ

6 Intellectual Propertyทรัพย์สินทางปัญญา

All ECU maps and calibration files created by Tune-Up remain the intellectual property of Tune-Up. Maps are licensed to the customer for use on the specific vehicle they were created for. Sharing, reselling, or reverse-engineering Tune-Up maps is prohibited.

7 Cancellation & Refundsการยกเลิกและการคืนเงิน

• Cancellation before any tuning work has begun: full refund of any deposit paid.
• Cancellation after the base map has been issued: deposit is non-refundable. Any additional amounts paid may be partially refunded at Tune-Up's discretion based on work completed.
• Tune-Up reserves the right to refuse or cancel a project if the vehicle or hardware is deemed unsuitable or unsafe for tuning, with a full refund of payments made.

• ยกเลิกก่อนเริ่มงาน: คืนเงินมัดจำเต็มจำนวน
• ยกเลิกหลังออก base map แล้ว: ไม่สามารถขอคืนมัดจำได้ ส่วนเงินที่ชำระเพิ่มเติมอาจได้รับคืนบางส่วน โดยพิจารณาตามสัดส่วนงานที่ดำเนินการไปแล้ว

8 Governing Lawกฎหมายที่ใช้บังคับ

These Terms & Conditions are governed by the laws of Thailand. Any dispute arising from the provision of Tune-Up's services shall first be attempted to be resolved through good-faith negotiation between the parties.

ข้อกำหนดและเงื่อนไขฉบับนี้อยู่ภายใต้กฎหมายของประเทศไทย หากเกิดข้อพิพาทใดๆ คู่กรณีจะพยายามแก้ไขด้วยการเจรจาโดยสุจริตก่อนเป็นอันดับแรก
